The toddler reported abducted yesterday from the Chattanooga area has been found, according to the Tennessee Bureau of Investigation. And the man accused of running off with her is in custody.

Reports indicate a resident spotted 37-year-old Matias Martinez and 23-month-old Octavia Shaw early this morning at the intersection of Boy Scout Road and Moses Road and alerted authorities.

When deputies safely recovered the girl, she was covered in dirt and debris, leaves and bug bites; they suspect she was outside all night, but they believe she’s okay. The child was taken to the hospital for evaluation as a precautionary measure.

Authorities with the Hamilton County Sheriff’s Office say Martinez abducted the girl after a traffic stop on Dayton Pike at Boy Scout Road around 3:30 p.m. local time.

In a correction from earlier reports, police now say Martinez was driving; police asked him to stand with the child in the shade at the side of the road while they questioned a female passenger, who had outstanding warrants. Martinez then fled with the child.

Martinez is charged with especially aggravated kidnapping. He’s being held on $150,000 bond and is due to appear in court May 29.
