A Cumberland County man has been released from probation by a judge after completing a rehab program and five years supervised probation stemming from the death of a child. Court officials say 38-year-old James Michael Eller was indicted by a grand jury back in 2008 for the death of his then girlfriend’s baby. Officers say Eller was under the influence of marijuana when he and the child fell asleep on a couch. Police say Eller in his sleep rolled over on the child smothering the baby. Eller was sentenced to serve five years on supervised probation and complete a long-term rehabilitation program for criminal negligent homicide. In court last Friday (September 8, 2017), the judge released Eller from probation after successfully completing the program.
